Extraordinary Ability

A person who possesses extraordinary ability must be part of a “small percentage” who have “risen to the very top of the field of endeavor.” Individuals of extraordinary ability have the chance of becoming United States permanent residents, and can also do so without an employer to submit a petition to USCIS for them being that that are allowed to “self petition.” In addition, they do not have to undergo the labor certification process.

Individuals must be capable of demonstrating extraordinary ability in the sciences, arts, and business, and even athletics on through sustained national or international recognition in the form of considerable documentation in the field. The individual possessing extraordinary ability is not required to have an offer of employment, however, he or she must be coming to the United States specifically to continue work in their field of extraordinary ability.
